Terms of Use

These Terms of Use govern your use of Euler Education’s educational products and private tutoring services. We reserve the right to modify these Terms of Use at any time, so please review them frequently.

1. Introduction

These Terms outline the rules for using https://www.eulereducation.com, https://www.eulereducation.co.za, and https://www.eulereducation.co.uk, along with their subdomains (collectively referred to as the “Website”), and establish the relationship between Euler Education (Pty) Ltd, trading as “Euler Education” (“Euler Education,” “we,” or “us”), and you. By accessing or browsing our Website, you agree to these Terms, which form a legally binding agreement between you and Euler Education.

If you use our Website as a visitor, these Terms will apply. For NBT course customers, the relationship will be governed by the “NBT Course Terms of Service” available below. For Private tuition customers, the relationship will be governed by the “Tutoring Terms of Service” available below. Similarly, if you engage with us as a tutor, the Memorandum of Agreement that you agreed to upon joined our company will govern our relationship.

2. Overall point of these terms

Your use of the Website is entirely at your own discretion, and we are not obligated to provide support or assume any responsibility for your general use of the Website. We are not liable for any damages, losses, or issues that may arise from your use or inability to access the Website. Any information provided on our Website is intended solely for general informational purposes and should not be relied upon as the basis for any actions you take.

3. Changes to our website and terms

We reserve the right, as permitted by law, to modify, update, or expand our Website, as well as to amend or add to these Terms at our discretion. Any changes will take effect immediately upon being implemented. While we may inform you of updates to these Terms, it remains your responsibility to review them each time you use the Website to stay informed about any modifications.

4. Use of our Website and it's content

You are prohibited from the following actions:

•Sharing or distributing any content from our Website without obtaining our prior permission;

•Using tools or technologies, such as crawlers or spiders, to search or extract information from our Website;

•Framing our Website or any of its pages;

•Linking to our Website in a way that bypasses the homepage; or

•Deep-linking to any pages on our Website in a manner that falsely implies ownership of our intellectual property.

5. Intellectual Property

All content and materials on the Website are the property of Euler Education (referred to as “Intellectual Property”). Unless explicitly stated otherwise, all rights, ownership, and interests in this Intellectual Property belong exclusively to Euler Education. You are not permitted to copy, reproduce, or use any of this content without first obtaining our written permission.

Using our Website or services does not grant you any ownership or rights over the Intellectual Property in any way.

6. Limited Liability

Euler Education is not responsible for any harm, loss, or damage that may arise from your use of the Website, including issues related to personal information or any data transmitted through the Website. Additionally, Euler Education accepts no liability for any harm, loss, or damage resulting from your reliance on the content provided on the Website.

While we have taken reasonable steps to maintain the integrity of the Website and its content, we do not guarantee that files, software, downloads, or other materials available on the Website are free from viruses or similar harmful software.

Tutoring Terms of Service

Terminology

“The Client” – Refers to the individual sponsoring (paying for) the tutoring lessons, which in most cases is their parent or guardian unless otherwise stated.

“The Student” – Refers to the individual who will receive tutoring lessons from their Euler Education allocated tutor

“The Tutor” – Refers to the individual conducting the tutoring lessons whose sole purpose is to help the student.

1. Lesson Scheduling & Rescheduling (one-on-one tutoring)

1.1 Lesson times that are agreed between the tutor and student must be adhered to at all times unless in the case of an emergency or valid commitment that has to be attended to at short notice by the student. The student must provide a valid reason as to why they cannot attend the lessons at the agreed-upon time accompanied by digital evidence such as a picture, message, screenshot, or any media format showcasing examples such as unforeseen school delays, family issues, health issues, etc. The validity of these reasons will be assessed by the tutor, and the Lead Education Manager if necessary. Should the reason be deemed as invalid, the lesson will be canceled and the client will not be refunded.

1.2 Should the student wish to reschedule, they must notify the tutor no later than the day before the date of their scheduled lesson so that the tutor can prepare for other sessions and reschedule accordingly.

1.3 Should the student request to reschedule the lesson without a valid reason on the date of the agreed lesson regardless of the time of day, the lesson will be canceled and not refunded to the client. It is the job of the student to always communicate a day in advance if they know that their schedule will change so that the tutor can reallocate time if need be. Our tutors are extremely busy and are highly sought after by other students, so it is a disservice to them to reschedule at short notice.

2. Late Arrivals

2.1 ​The tutor is not obligated and will not extend the end time of the lesson or workshop if a student arrives late to a session. It is the job of the student to always ensure that they are on time for lessons.

3. Student No-shows (one-on-one tutoring)

3.1 Should the student not show up to a scheduled lesson without notifying the tutor that they will not attend, the lesson will be deemed as canceled and the client will not be refunded. It is the job of the student to ensure they notify the tutor for whatever reason, that they want to reschedule a lesson so that the tutor has sufficient time to plan and allocate time for the student. If the student was in a severe or emergency situation and could not contact the tutor, a negotiation can be made but the student must provide sufficient evidence as per clause 1.1, to prove that they could not contact the tutor. The tutor will decide if the evidence is valid, and grant the privilege to reschedule for a later date should the evidence be deemed valid.

4. Payment Policy

4.1 All lesson packages/monthly packages are prepaid – thus it is the responsibility of the client to ensure that they pay first before the package lessons can commence.

4.2 The tutor is not obligated and will not start lessons if the client has not yet paid.

5. Refunds Policy (one-on-one tutoring)

5.1 Unused lessons up to an amount of 10 hours will be refunded if a refund is requested by the client within 40 days of the client being billed for lessons. 

5.2 If a student does not show up to a lesson without notifying the tutor that they will no longer need the lesson within 1 day before the lesson’s scheduled time, the client will not be refunded for that particular lesson.

5.3 All refunds will be transferred via bank transfer, which should take 3-5 business days for the funds to reflect in the clients bank account.

7. Client & Tutor Conduct

7.1 It is the job of the student and tutor to maintain a professional relationship throughout the course of the contracted sessions. ​

7.2 Under no circumstance may the tutor or student use any profanity.

7.3 The student must maintain a good behaviour and display proper etiquette to the tutor to maintain a respectful and good relationship between both parties.

8. Termination of Service (one-on-one tutoring)

8.1 The client may, under severe circumstances terminate the packages should they not be pleased with the tutoring service. They will be refunded according to the policy stipulated in clause 5.1.

8.2 The tutor reserves the right to terminate the lesson plan with immediate effect only if the client and/or student displays non-cooperative behaviour despite the tutor trying at least three times to get the student and/or client to co-operate.

8.3 The tutor reserves the right to terminate the package provided that they have provided the client with a valid reason (either work, health, school or family related) no less than 4 weeks in advance of the package termination.

NBT Course Terms of Service

Refunds Policy

1. Online tutoring refunds

5.1 Unused lessons up to an amount of 10 hours will be refunded if a refund is requested by the client within 40 days of the client being billed for lessons. 

5.2 If a student does not show up to a lesson without notifying the tutor that they will no longer need the lesson within 1 day before the lesson’s scheduled time, the client will not be refunded for that particular lesson.

5.3 All refunds will be transferred via bank transfer, which should take 3-5 business days for the funds to reflect in the clients bank account.

2. NBT course refunds

2.1 A client is eligible for a refund of any of our NBT preparation courses only within 5 days of purchase. After 5 days after purchase will the clients refund eligibility be expired.

2.2 In order to request a refund, clients are required to submit a signed affidavit, provided by both the parent and the student, within 36 hours of the refund request. The affidavit must confirm that no attempts have been made to screenshot, record, or download the course content for offline use. This is to protect the intellectual property rights of Euler Education (Pty) Ltd., as all course materials are owned exclusively by the company.

By law, the course content provided by Euler Education (Pty) Ltd. is protected under South African intellectual property and copyright law, specifically the Copyright Act No. 98 of 1978, as amended. This Act prohibits the unauthorized reproduction, distribution, or sharing of copyrighted material without the explicit consent of the copyright holder.

Intellectual Property Rights:

1.All course materials are the exclusive intellectual property of Euler Education (Pty) Ltd. and may only be distributed or shared by the company.

2.Parents or students are not authorized to copy, share, or distribute any part of the course content, whether for personal use, monetary gain, or free distribution.

Consequences of Violations:

•Any attempt to share, reproduce, or distribute the course content outside the Euler Education platform, either for profit or for free, constitutes a violation of the Copyright Act No. 98 of 1978 and South African intellectual property law.

•Such violations may result in legal action being taken by Euler Education (Pty) Ltd. This includes claims for damages and injunctive relief to prevent further unauthorized use.

Summary of Key Responsibilities:

•Parents and students must adhere to these terms and ensure the confidentiality of course content.

•Unauthorized sharing or distribution, in any form, infringes on the intellectual property rights of Euler Education (Pty) Ltd. and will be met with strict enforcement under applicable laws.

By agreeing to these terms, clients acknowledge their responsibility to protect the integrity of Euler Education’s course materials and comply with South African copyright and intellectual property law.

2.3 Refunds for the online 1-on-1 NBT tutoring will only possible based on clause 2.1 and if the lessons have not commenced yet.
